BICYCLES ELECTRIC SELF-SERVICE – GENERAL CONDITIONS OF ACCESS &
USE BY SUBSCRIBER MOBILITY IN THE SERVICE PARK
ARTICLE 1 – PURPOSE OF THIS AGREEMENT
1.1 This contract is for the Bikes loan or rental device Electrically Assisted self-service (the “Service”) offered by Wattworld SA (the “Owner” and “Service Provider”) available to users of the park electric bikes (the “Users”).

ARTICLE 2 – STRUCTURE OF SERVICE
2.1 The Service consists of stations, the “Station (s)” with attachment points and automatic recharging of Electrically Assisted Bicycles belonging to the Service (the (s) “Point (s) of attachment and recharge” ).
2.2 Each station has multiple functions:
• allow through badgeurs to unlock a bike Electrically Assisted with a staff badge or smartphone. The badge can also be provided on site by the operator after registration and payment;
• reposition a Electric Bicycle Assistance on a free attachment point;
• check the level of charge Bike Electrically Assisted;
• declare a blocking fault on the bike Electrically Assisted returned.
2.3 Each attachment and charging point enables locking a bike Electrically Assisted.
ARTICLE 3 – AVAILABILITY OF SERVICE
3.1 Once it is registered to the service on the Internet platform or by the Operator of the park, the User may use the Service for a period of 48 consecutive hours ( “Using Authorised Continuous Time”).
In case of dispute on the bike Period of Use of Electrically Assisted by the User, authentic data output from the computer server of the Service.
3.2 The Service is accessible, within the limits of Electrically Assisted Bicycles available in each Station, 12 out of 12 months, 7 days 7 without interruption, except for manual registration opening hours of the Operator or office case force majeure or enactment by the competent authorities of a total or partial restriction, temporarily or permanently, the use of one or more stations or bicycle traffic on the Service implanting territory.
ARTICLE 4 – HOW TO ACCESS THE SERVICE
4.1 CONDITIONS OF ACCESS IN CASE OF TAKING ON THE FLY
(1) With a smartphone with a web browser, the User must flash the QR code displayed near the Station or manually connect the www.wattworld.ch/mobilityparc site.
He must then choose “Taking on the fly” and perform quick registration procedure.
(2) Following registration (name, email and bank references), the User is prompted to type a code (shown on screen) using the buttons next to the bike automatically designated by the service IT Service.
Once the indicated code, Electrically Assisted Bicycle unlocks automatically and the User can remove it. The user can also ask other rent bikes (bikes rented 4 maximum).
The User then starts, if desired, the Electrically Assisted by pressing the On / Off button located on the bike console Electrically Assisted which has been assigned.
4.2 CONDITIONS OF ACCESS IN CASE FULL REGISTRATION ONLINE
(1) The Registration Service is available on the website www.wattworld.ch/mobilityparc.
(2) Following registration (administrative data and bank details), the User is informed by email his Identifiers (login and password digital) and receives by mail a personal badge (within days) or recovered from d an operator of a station, it should keep and use for each loan bike Electrically Assisted in connection with the Service.
(3) The User can reserve a bike Electrically Assisted by identifying the www.wattworld.ch/mobilityparc site. He then went on the selected station in his book and identifies the station using his badge at level to Point
Once identified on one of the points, the User can unlock a bike Electrically Assisted.
The User then starts, if desired, the Electrically Assisted by pressing the On / Off button located on the bike console Electrically Assisted which has been assigned.
(4) The User can also borrow a bike Electrically Assisted reservation, subject to availability, in badgeant directly on the station.
4.3 CONDITIONS OF ACCESS IN CASE OF REGISTRATION BY OPERATOR
(1) The Registration Service is performed by the Operator
(2) Following registration (administrative data), after payment of the desired badge of credit), and deposit a copy of part of the identity, the User is given a personal badge credited the amount paid, that he must keep and use for each loan bike Electrically Assisted in connection with the Service.
(3) The User is then identified on the Station with his badge at the attachment point.
Once identified on one of the points, the User can unlock a bike Electrically Assisted.
The User then starts, if desired, the Electrically Assisted by pressing the On / Off button located on the bike console Electrically Assisted which has been assigned.
4.4 TO RETURN THE BIKE
At the end of its lease, User shall hang up the bike Electrically Assisted to an attachment point available on the Station. The Electrically Assisted Bicycle is recognized, and reloaded automatically locked
A bike Electrically Assisted unreturned remains under the responsibility of the User.
Billing Service stops when the Electrically Assisted Bicycle is returned. Beyond the Use of Time authorized continuous 24 hours, tolerance may be observed up to 48 hours. After this maximum length the user will be contacted in order to regularize the incident.
ARTICLE 5 – SERVICE USERS
5.1 Registration Data and the associated identifiers and the badge are strictly personal and enable the User to remove, use and return a Bicycle Electrical Assistance under the conditions described herein.
5.2 The Service is accessible, subject to the provisions of Articles 4.1 and 4.2 above and Article 7 below, to the Subscribers.
ARTICLE 6 – RATE CONDITIONS
6.1 HOURLY RATES OF USE OF THE SERVICE
The User pays the price of the Service as a proportion of the Service usage time ( “Working Time”).
• Rates are specified with the Operator, near the station and on the website www.wattworld.ch/mobilityparc
• Every hour started is charged in full.
6.2 STATEMENTS OF USE AND BILLING
In the case of online registration or decision on the fly, after each use, a statement is generated and accessible on the www.wattworld.ch/mobilityparc site, and informed account by the User at its registration is debited at the end of the month the amount corresponding to the duration of use.
When purchasing a prepaid badge from an operator, an invoice is sent by email. After each use, the card is debited with the amount corresponding to the rental place. The user must be presented to the operator to check the balance of his badge. If the balance of the badge is negative, the User agrees to carry a minimum of immediate payment of the balance.
When a claim on one of those races, the User must provide the corresponding race number, allowing the identification of locations and times of taking and removal of Electrically Assisted Bicycle.
6.6 The rates and prices in this Article shall apply from 1 January 2015. They will be reviewed by the Owner. Clients will be informed in advance of the entry into force of the new rates.
ARTICLE 7 – OBLIGATIONS OF USERS
7.1 The User agrees to use its own identifiers or her own badge to identify themselves on the www.wattworld.ch/mobilityparc site or from the Contractor and Owner, and to borrow a bike Electrically Assisted .
7.2 The User agrees to use the Service in person ordinarily prudent, diligent and prudent, and in compliance with these C.G.A.U.
7.3 The User has custody of or bike (s) Electrically Assisted he withdrew. It will prevent its degradation, destruction or disappearance. He will always lock the Lock Bike Electrically Assisted around a fixed point of attachment when it files its Electrically Assisted Bicycle outside station. Otherwise, the bike Electrically Assisted will be considered unsecured.
7.4 The User agrees to remove and return the Bicycle Electrically Assisted in time for the Use Authorised Continuous Time.
The User accepts in advance that any breach of this obligation will entitle the Contractor to the collection or payment of a fixed penalty of € 150 per bicycle rented, the final amount is set according to the terms and conditions provided for in Article 11.
7.5 In the event of a finding of use of the bike Electrically Assisted contrary to the provisions of Article 7.2 above, the User agrees to return the bike Electrically Assisted at any time, at the first request of the Supplier or Owner or their representatives.
7.6 The User agrees to report in the shortest possible time to
Owner loss or theft of Electrically Assisted Bicycle or any other problem relating to the use of its IDs, and at most within 24 hours of the occurrence of the event by contacting the call center by dialing 022 796 43 43 or by writing to info@wattworld.ch the Electrically Assisted Bicycle remaining in any case under its responsibility under the terms of Articles 7.3 and 9.1
Users have the ability to report to the Provider any fault occurred on a bike Electrically Assisted www.wattworld.ch/mobilityparc from the site.
ARTICLE 8 – RESTRICTIONS ON THE USE OF THE SERVICE
8.1 It is forbidden to the User to lend, rent or lease its
Badge and credentials associated with the Service and / or use them in any other way than as provided herein C.G.A.U.
If the User has lost its numerical password, he can make a request to acquire a new www.wattworld.ch/mobilityparc on the site.
If the User Login lost her digital, it can make an application for renewal to the owner via the www.wattworld.ch/mobilityparc site.
If the User has lost his badge, he can make an application for renewal to the owner via the www.wattworld.ch/mobilityparc site.
8.2 It is expressly forbidden to the User to allow in any way whatsoever use, free or not, the
Electrically Assisted Bicycle by third parties whatsoever.
8.3 Access to the Service is also open to children from 14 years of age, their subscription is their legal guardian or under its responsibility and in accordance with section 8.5 below.
8.4 The User is authorized to use the bike Electrically Assisted as hereunder provided that in use is reasonable, which rules include:
• any use contrary to the provisions of the applicable traffic regulations, in particular the provisions of the Highway Code;
• any use on land or in conditions that damage the bike Electrically Assisted;
• transportation of any passenger is in any way whatsoever;
• any use of Electrically Assisted Bicycle could jeopardize the User or third parties;
• any dismantling or attempt to dismantle all or part of Electrically Assisted Bicycle;
• and more generally, any abnormal use of Electrically Assisted Bicycle.
8.5 Access to the Service is prohibited for any person under 14 years, accompanied or not. Like any user of the Service, a minor over 14 years old must hold Personal identifiers.
8.6 Electrically Assisted Bikes can support a total load greater than 120 kg. The rear luggage rack can bear a load greater than 25 kg.
8.7 The Owner and the Contractor have set up an internal treatment for the prevention of risks, authorized by the CNIL, excluding the service people at risk for up to 5 years. Persons on this list may exercise the right to access, rectify and, if applicable, of opposition to be included in this treatment for legitimate reasons, addressing the Owner (contact details in article 1 hereof).
ARTICLE 9 – RESPONSIBILITIES & RETURNS
USERS
9.1 The User is fully and solely responsible for damages caused by the use made of Electrically Assisted Bicycle throughout its Period of Use, including when it exceeds the Use of Authorised Continuous Time for late restitution by the User.
9.2 The parents or legal guardian of any minor registered with the Service, be liable for any damage caused directly or indirectly by the minor as a result of using the Service.
9.3 Any borrowing more than 24 hours is considered a case of disappearance of the bike Electrically Assisted until it is found.
9.4 In case of disappearance of the bike Electrically Assisted which it is responsible, the User is obliged (Article 7.6) to report the disappearance to the Operator or the owner at 022 796 43 43 or by writing to info @ wattworld.ch within 24 hours of the initial loan and within 48 hours to file with the police a complaint of theft, Electrically Assisted Bicycle remaining under its full responsibility until communication owner of a copy of the filing of a complaint.
9.5 In case of accident and / or incident involving the Bicycle Electric Assistance, the User has the obligation (Art. 7.6) to report the facts in time and number and / or address email above. The Electrically Assisted Bicycle remains under the responsibility of either until locked to an attachment point, until its handover to a representative of the Owner. Otherwise, the User must secure the bike Electrically Assisted by the corresponding Theft.
9.6 The User declares to be able to use a bike Electrically Assisted and have the physical condition suitable for this use.
9.7 The Electric Bicycle Assistance is under the responsibility of the User (see sections 7.3 and 9.1), it is recommended to him that, prior to the actual use of Electrically Assisted Bicycle removed at a basic check of the main functional elements, including (non-exhaustive list):
• tight fit of the saddle, pedals and saddle bags;
• the functioning of the bell, brakes and
• lighting;
• the good condition of the frame and tires.
9.8 It is further recommended to the user:
• adapt braking distance in bad weather;
• perform the saddle adjusting to adapt its height to its morphology;
• wear an approved helmet and suitable clothing;
• and, in general, respect the highway code in force at the time of use by the User of the Service (eg to observe traffic lights, do not ride on the sidewalk, etc.)
9.9 The User declares that all information regarding the product is accurate, especially that it meets the requirements in sections 4.1 and 8.6 and that he holds a civil liability insurance policy.
ARTICLE 10 – PENALTIES
10.1 AMOUNTS AND TERMS
(1) During his registration, to provide security that can be exercised in full or in part by the Contractor in the cases and under the conditions detailed below and exhaustively listed: deteriorating, fraudulent, improper locking and / or non-restitution the corresponding key (see section 4.2), no refund and / or disappearance of the bike which the User is responsible, the User information section of the credit card form.
(2) The amount of penalties (see Article 10.1 (3)) is payable at first request of the Contractor, in case of finding of a breach of the User of its obligations hereunder.
(3) The nature and / or the amount of penalties due to the Provider by the User in case of breach of the latter are as follows (see sections 4.4, 7.4, 9.3 and 9.4 hereof):
• Bicycle theft Electrically Assisted with deteriorating Theft or violence to the person: 35 € (the receipt of the complaint made to the police as proof);
• disappearance of a Bicycle Electrically Assisted less than 48 hours after the start of rental: 75 €;
• disappearance of a Bicycle Electrically Assisted less than 7 days of the rental period: € 100;
• disappearance of Electrically Assisted Bicycle 7 days and beyond: the User is charged € 150 per week (up to 11 weeks), as long as it does not file a complaint for theft or loss from the authorities competent and do not make the required supporting documents;
• repair of damage by bike Electrically Assisted attributable to the User: lump sum depending on the degree of degradation.
10.2 The User agrees to report any change in his relationship with the bank whose details have been provided as part hereof C. G. A. U., likely to affect the successful completion of the debit authorization granted by that bank.
ARTICLE 11 – DATA PROTECTION
The provider, responsible for processing, is implementing automated processing of personal data for the management of users of Electrically Assisted Bicycle Service.
The collected data is essential for these treatments and are used by the departments concerned of the Contractor and the Owner.
Pursuant to the law on the protection of personal data, the Customer has a right to query, access, rectification and opposition for legitimate reasons regarding all data concerning him, he can exercise by mail to Wattworld SA 158 – rte Aïre – 1219 Aïre, enclosing a copy of an identity at her request.
ARTICLE 12 – SETTLEMENT OF DISPUTES
In case of complaint, the User can enter the owner is using the form provided for that purpose on the website
www.warttworld.ch or by letter sent to the address in section 1.2 hereof. It has to do this for a period of six (6) months after the disputed event.
These are subject to French law. Any dispute relating to their implementation and their consequences will be submitted to the jurisdiction of competent courts of Geneva to which the Parties expressly attribute jurisdiction, including in case of summary proceedings of appeal or multiple defendants.
ARTICLE 13 – MODIFICATION OF THESE C. G. A. U.
The users will be automatically notified of any changes to these C. G. A. U. www.wattworld.ch/mobilityparc on the site.
